DIXIE AERIAL PHOTOGRAPHY

DIGITAL IMAGE LICENSE AGREEMENT

IMPORTANT NOTICE: By purchasing and downloading any digital asset from Dixie Aerial Photography, the Buyer explicitly agrees to be bound by the terms and conditions of this License Agreement.

1. PERSONAL USE LICENSE ($5.00)

A. Permitted Uses

Dixie Aerial Photography grants the Buyer a non-exclusive, non-transferable, perpetual right to use the licensed image(s) for personal, non-commercial purposes only. Permitted uses include:

• Displaying the image(s) on personal computers, mobile devices, and personal home screens.

• Printing physical copies of the image(s) for personal display, home decoration, or gifts (e.g., framing, photo albums).

• Posting the image(s) on personal, non-monetized social media accounts, provided that credit is given to © Dixie Aerial Photography.

B. Prohibited Uses (Strict Boundaries)

Under the Personal Use License, the Buyer SHALL NOT:

• Use the image(s) for any business, commercial, promotional, or editorial purpose.

• Use the image(s) on any real estate listings, multiple listing services (MLS), or property marketing material.

• Resell, sub-license, redistribute, or share the digital image files with any third party.

• Upload the image(s) to "Print on Demand" websites (e.g., Zazzle, Redbubble, CafePress) for commercial resale.

2. EXTENDED COMMERCIAL LICENSE ($50.00)

A. Permitted Uses

Dixie Aerial Photography grants the Buyer a non-exclusive, non-transferable, worldwide, perpetual right to use the licensed image(s) for commercial, promotional, and corporate purposes. Permitted uses include:

• Real Estate Marketing: Unlimited use on digital platforms (MLS, Zillow, social media property ads) and printed marketing materials (flyers, brochures, yard signs) to market and sell a specific property or highlight an agency's portfolio.

• Digital Media: Inclusion on commercial websites, business blogs, corporate social media accounts, email marketing newsletters, and digital advertisements.

• Print & Publication: Use in local or national print advertisements, magazines, news articles, book covers, and corporate promotional brochures.

• Physical Business Display: Printing the image for display inside a commercial space, office building, or storefront owned or leased by the Buyer.

B. Prohibited Uses

Under the Extended Commercial License, the Buyer SHALL NOT:

• Resell the digital image file as a standalone asset, stock photo, or part of a digital template pack.

• Claim authorship or exclusive copyright over imagery.

• Use the image(s) in a defamatory, offensive, or illegal context.

3. COPYRIGHT & OWNERSHIP

• Retention of Rights: Dixie Aerial Photography retains full title, copyright, ownership, and intellectual property rights to all images. This agreement is a license to use the imagery, not a transfer of ownership or copyright.

• No Exclusivity: All licenses are strictly non-exclusive. Dixie Aerial Photography reserves the right to continue licensing the same image(s) to other clients, businesses, or entities.

4. LIMITATION OF LIABILITY & WARRANTY

• "As-Is" Delivery: Digital assets are delivered "as-is" in high-resolution format. Dixie Aerial Photography makes no warranties, express or implied, regarding the accuracy, quality, or fitness of the image for a specific printer or layout beyond standard digital compatibility.

• Drone Logistics & Compliance: Dixie Aerial Photography warrants that all aerial images were captured in strict compliance with federal, state, and local drone regulations (including FAA Part 107 rules where applicable).

• Maximum Liability: In no event shall Dixie Aerial Photography be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use the licensed images. Dixie Aerial Photography's total liability shall not exceed the price paid by the Buyer for the specific image license.
